Yusril receives information that Hambali will hear at the US Military Court next month

Jakarta – Coordination of Minister of Law, Human Rights, Immigration and Community Affairs (Kumham Imipas), Yusril Ihza Mahendra, conveyed the latest news about the suspect of terrorism held in Guantanamo, Encep Nurjaman alias Hambali. Yusril received information that Hambali would start in the United States in November. “Hambali there is no news now. The last news we heard was that the US military court would start in November this year, but there were no recent developments,” Yusril explained to reporters at his office, Kuningan, South Jakarta, Thursday (9/10/2025). Nevertheless, he said that the US Ambassador on the meeting did not provide much information. “And some time ago, the US Ambassador came here, and we touched this issue. But he said he didn’t have much information about this issue, he just heard that he would be heard in the United States in November. So far we don’t know the developments,” Yusril said. Previously, the Indonesian government was still waiting for the United States Military Court for the citizenship status of the terrorism suspects detained in Guantanamo, Encep Nurjaman alias Hambali. Yusril is still considering returning to Indonesia if he is truly an Indonesian citizen (WNI). “I made a press release some time ago and emphasizes that the Indonesian government is not yet clear to this day about the status of Hambali citizens,” Yusril on Sunday (15/6) told reporters in Depok, West Java. Because Yusril said, during his 20 years in Guantamo Prison, Hambali did not communicate with the Indonesian government, although he had an advocate in Indonesia. “Because he was detained in Guantanamo for more than 20 years, there was almost no communication between the person and our representatives or the central government, although there was a lawyer in Jakarta,” he explained. The Indonesian government could not confirm the citizenship status of Hambali, because when he was arrested in Thailand, Hambali had a Spanish and Thai passport. Hambali did not show his identity as an Indonesian citizen at all. “But, what exactly is the nationality of Hambali? It can’t be confirmed yet. Because when he was arrested in Thailand more than 20 years ago, he held a Spanish passport and a Thai passport at the time. And he did not show an Indonesian passport or proof or identity that he was an Indonesian citizen,” he said. Yusril explained that in accordance with the Citizenship Act, if a citizen does not have a passport, his or her status as an Indonesian citizen is lost. “As we know, based on our citizenship law, if an Indonesian citizen becomes a citizen of another country and has a passport from another country, his Indonesian citizen status will automatically be lost,” he said. For this reason, Yusril continued, the Indonesian government is still awaiting the decision of the US Military Court on Hambali’s citizenship status. The Indonesian government also first looks at the benefits of Hambali that comes to Indonesia if he is not an Indonesian citizen. “And therefore, although the person concerned is currently being tried by a military court in the United States, we want to wait for the real judgment of the court, then it will become clear what the true nationality of this Hambali is,” he said. “If he is not an Indonesian citizen and the Indonesian government first looks at his situation, there is any benefit to him who returns to Indonesia or not,” he added.
