Attorney General approves criminal contempt case against lawyer who misbehaved with CJI

New Delhi, October 16 (IANS). The misconduct case against Chief Justice BR Gavai in the Supreme Court has now taken a new legal turn. Attorney General of India R. Venkataramani has given permission to initiate criminal contempt proceedings against accused lawyer Rakesh Kishore. This approval was given on the application of Supreme Court Bar Association (SCBA) president Vikas Singh. R. Venkataramani said in the acceptance letter that he had carefully studied all the documents and facts related to the incident. Advocate Rakesh Kishore’s conduct amounts to criminal contempt under Section 2(c) of the Contempt of Courts Act, 1971. Venkataramani said, “The conduct and statements of Rakesh Kishor are not only derogatory to the dignity of the court, but also seem to be aimed at undermining the prestige and authority of the High Court system and the authority of the Supreme Court. shakes public confidence in the judiciary, especially when the matter touches the highest court of the land.” He said that under no circumstances can any person justify contempt of court or the targeting of judges. “Throwing any object at the judges or shouting about the court proceedings is a serious insult to the dignity of the court,” he said. The Attorney General also made it clear that no amount of explanations or reasons given by lawyer Rakesh Kishore could justify this immoral and abusive behaviour. He called it a direct attack on the ‘rule of law’ and the dignity of the judiciary. He also mentioned that lawyer Rakesh Kishore has not expressed any remorse or regret for his behavior so far. It is clear from his subsequent comments that he has shown no remorse for his actions. “I give my consent under section 15(1)(b) of the Contempt of Courts Act, 1971 to initiate criminal contempt proceedings in the Supreme Court against Rakesh Kishore,” the Attorney General said. This decision of the Attorney General will now be presented to the Supreme Court, after which the court will decide when and how the formal trial against Rakesh Kishore will begin. –IANS VKU/VC Share this story Tags
