Business owners who have been imposed on a mistake are entitled to obtain a pension – ryan

The period of payment of business owners who pay compulsory social insurance will be registered before July 1, 2025 to resolve the system, according to the decision of the Standing Committee of the National Assembly.

The President of the National Assembly, Tran Mann, just signed and issued Resolution No. 78/2025 of the Standing Committee of the National Assembly regarding the registration of the mandatory social insurance period for home business owners who participated before entering the Social Insurance Law 2024 into effect.

Accordingly, the time for the entitlement to the social insurance entitlements to business owners who paid their contributions will be recorded before July 1, 2025. The business owners who fulfilled the conditions for benefiting from social insurance before the mentioned date, their entitlement to benefits will be calculated from the date of their entitlement.

The government undertakes the implementation of this decision, solving emerging problems, and ensuring the rights of business owners.

According to the current regulations, business owners must pay a mandatory social insurance for contracting and tenant workers; While business owners are not subjected to mandatory payment. However, according to the report of the Committee in May 2023, many business owners were imposed illegally.

According to the social security statistics in Vietnam, from 2003 to May 31, 2023, 3567 employers paid a mandatory social insurance for the Social Security Fund at a value of 113 billion Vietnamese dungs. More than 9,600 employers obtained satisfactory leave and maternity subsidies of approximately 13.3 billion dung Vietnamese; 275 people obtained pensions and death compensation for more than 32.8 billion Vietnamese dungs; 397 people got one social insurance with a value of approximately 9.4 billion dung vitnami.

According to the Ministry of Labor, Disabled Affairs and Social Affairs (previously), the collection of the Social Insurance Authority for mandatory social insurance premiums from business owners is not compatible with the law, and in principle, these funds must be returned. However, there are fears that the return of money will lead to problems due to the incorrect collection for up to 20 years, as many people have received entitlements, and many homeowners have reached retirement age and need to guarantee social security benefits. After the discussion, the two parties agreed to propose a mandatory payment period so that homeowners can benefit from the benefits.
