The survivor claims she met the man at a bar, in which he said he was intoxicated and raped her twice in his family member’s apartment after she agreed to rest to his place. (Representative Beeld) The Judge of the High Court in Allahabad, Sanjay Kumar Singh, said the woman “invited trouble himself” and was “responsible” for an alleged rape while giving bail to the accused. The survivor claims she is intoxicated and the man meets at a bar. He raped her twice in the apartment of his family member after she agreed to rest to his place, she said, Live Law reported. “She was responsible” a Bank of Justice Sanjay Kumar Singh noted, “This court believes that even if if the victim’s allegation was accepted as true, it could also be concluded that she herself invited problems and was also responsible for the same. Similar position was taken by the victim in her statement. In her medical examination, her hymn was found, but Doctor gave no opinion on the sexual assault. ” The bank added that the survivor as a mother student was able to understand the ‘morality and meaning of her act’, as revealed by her in a first information report (FIR). Survivor claims that the intoxicated accused, according to the survivor, touched her, she, from her own choice, went to a bar in Delhi with three female friends, where they took alcohol, after which she became intoxicated. She further claimed that she was at the bar until about 3am, and during her time there the accused held to tell her to accompany him to his home. As she needed support because of her condition, she agreed to rest with him. She further claimed that the man touched her during the trip improperly, and instead of taking her to his home in Noida as she expected, he took her to a relative’s apartment in Gurgaon, where he allegedly raped her. The advocate of the accused, while sought bail, argued that even if all the allegations were considered true, it was not a rape case, but it could be a case of consensual relationship between both parties involved. The arguments said that the accused has been in jail since December 2024, without any criminal history, and that if he is dropped on bail, he will not utilize the bail and will work together to ensure the rapid solution of the case. Additional government lawyer for the state did not agree with the applicant’s bail in the aftermath of the fir, but he did disputed the above factual aspect of the case, as said on behalf of the applicant. Court order bail The court ruled, “taking into account the facts and circumstances of the case, as well as to retain the nature of the O1ence, evidence, complicity of the accused and submissions of the learned advocate for the parties, I believe that the applicant made a case for bail.
