Earlier, in July 2023, the Delhi High Court had the establishment of three designated/special courts at the Rouse Avenue Court Complex in the capital to deal with matters against MPS and MAs under the Children’s Rights Protection Act (CPCR), 2005 and the protection of children against sexual violation (POCSO), 2012. held for more than three years without any reason. The proposal for the approval of the Lieutenant -Governor for the Constitution of this designated/special courts under section 25 of the CPCR Act and section 28 of the Pocso Act was submitted by the Department of Women and Child Development of the Delhi Government and investigated by the legal department. These three courts are in addition to the eight courts already notified to hear crimes against children, the violation of children’s rights and offenses under the Pocso Act. Section 28 (1) of the Pocso Act provides that the state government, in consultation with the Chief Justice of the Supreme Court, for a quick trial by notice in the official Government Gazette appointed a session court for each district as a special court for the trial of offenses under the Act. Article 25 of the CPCR Act states that the state government at least one court in the state or, for each district, a session court as a children’s court for the hearing of the state or the judge of the main court, for a rapid trial of cases of crimes against children or the violation of child rights, at least one court in the state or, for each district, a sitting court as a children’s court.
