The Patient Patients Act No. 71 of 2009 specified the controls and conditions, to protect the patient, which does not allow him to enter a psychiatric clinic except with the approval of a specialist doctor.
Article 13 of the law stipulates that no person may enter into a treatment for a treatment in one of the mental health facilities except with the approval of a doctor who specializes in psychiatry, when there are clear signs indicating the presence of severe mental illness whose treatment requires the entry of one of the mental health facilities, in the two following cases:
The first: the possibility of a severe and visible deterioration of the psychological state.
The second: If the symptoms of mental illness represent a serious and threatening threat to the safety, health, life of the patient, safety, health and lives of others.
In these two cases, the patient must be rejected to enter the facility to receive the necessary treatment, provided that the family, the director of the facility and the social service office affiliated with the patient’s residence and the National Council for Mental Health or the Regional Council for Mental Health are informed of the decisions of the patient’s enforcement decisions within twenty -four hours of entering a report with a report that includes an evaluation of his health condition, all as determined by the executive regulations of this law.
Article 14 of the law stipulates that a doctor who is not specialized in psychiatry in one of the mental health facilities stipulated in this law may be stipulated in the two cases stipulated in the previous article and in accordance with the provisions stipulated in it to enter a patient without his will to assess his condition for a period not exceeding forty -eight hours, based on a written request submitted to the facility from any of the following persons:
1- One of the patient’s relatives to the second degree.
2- One of the police officers.
3- Social specialist in the region.
4- The specialized health inspector.
5- Cursing the state to which the foreign patient belongs.
6- One of the professionals of psychiatry who does not work with this facility and does not have a relative link to the patient or the director of the facility up to the second degree.
The matter is presented to the Public Prosecution within a period not exceeding twenty -four hours to take what is necessary.
The responsible psychiatrist may cancel the mandatory entry before the end of the period referred to in the first paragraph of this article if his justifications are based, provided that he informs this to both the facility director, the social service office and the regional mental health council while informing the patient and parents, noting this decision.
