'Command of Punjab-Hariyana HC, who are senior officers in the case of drug smuggling from prison; SSP record until May 16

The Punjab High Court and Haryana have ordered the DGP to be appointed as senior officer to investigate drug smug cases from the Amritsar prison. The court reprimanded SSP Amritsar (rural) for negligence in the questioning of jail officials. The mother ordered the SSP to appear with an investigative record on May 16. State Bureau, Chandigarh. In the case of drug smuggling from Amritsar Prison, the Punjab and Haryana High Court ordered the DGP to deploy an ‘extremely senior officer’ to investigate cases related to drug smuggling from state prisoners. The court gave this order when the SSP of Amritsar (rural) was reprimanded by Justice NS Shekhawat for the adoption of a ‘very careless attitude’ over the interrogation of the prison authorities. Incorrect justice Shekhawat made strict remarks to act only at the lower level employees, saying that only the tradition of employees in these cases is wrong in these cases. “In such cases, this is expected to take appropriate legal action against senior prison officers, which the police often leave for no concrete reason.” He ordered the SSP of Amritsar (rural) to appear in court in court on May 16. The remark comes during a joint trial of three cases in which the accused was allegedly involved in drug smuggling in the Amritsar Central Jail. The order to review the investigative file to the SSP has already made it clear that such crime is not possible without the ‘active collusion’ of the prison administration and the local police. The court said the SSP was already aimed at reviewing the investigation file itself and submitting an affidavit and explaining why the prison officials were not accused, but that the SSP handed the work to a DSP. The court described it as a behavior that reached the rand of contempt of court. Justice Shekhawat said: “When the SSP was clearly instructed to read the file personally and he could not hand over the responsibility to the DSP.” The court also said that the Amritsar (rural) police are not done according to his own investigation and the investigation process according to the rules prescribed under CRPC/BNSS. The court also surprised that the police were only waiting for departmental action and did not immediately question the prison authorities. Justice Shekhawat said it was surprising that police accepted that senior officials of the prison would take departmental action against their subordinates, while the criminal investigation could conduct independently according to the law. Justice Shekhawat said that “it is painful to see that, despite the court’s instructions, some questions to the superintendent of the central prison Amritsar, who is suspicious, cannot go into jail without their collusion.
