The High Court in Allahabad granted bail to rape accused, 'the woman himself invited trouble'

The Allahabad High Court granted bail to an accused of rape, as the complainant caused trouble to go to the applicant’s home after drinking alcohol, the news came a few days after the Supreme Court (SC) a few days after the Supreme Court (SC) intervened to stop the ‘insensitive’ order). The order passed by Justice Sanjay Kumar Singh last month said that the woman was a mother student, and that she could understand the ‘morality’ and ‘importance’ of her act. The applicant had earlier argued that the woman is an acceptable matter that she is an adult and lives in the PG residence. She went with her female friends to a restaurant and her male friends on her own free will, where they all drank alcohol. As a result, she was very intoxicated. The applicant’s lawyer argued that the woman stayed with her friends until 3 in the morning. As she needed help, she went to the applicant’s home and agreed to rest. The lawyer told the court that his allegator that the requester had taken him to his family member’s apartment and raped him twice, liar and against the evidence in the record. It has been argued that a case of consent relationships the facts of the case mentioned by the woman cannot be a case of rape, but a matter of consenting relationship between the parties involved. The court said: “After listening to the learned lawyer of the parties and investigating the whole case, I think there is no dispute that the victim and the requester are both adults. The victim is a student of mother, so she could understand the morality and importance of her actions in the fir.” The court said: “The court believes that even if the victim’s claim is accepted as true, it can be said that she herself created problems and is responsible for it. The victim also took the same stance in her statement. It was found that her vaginal membrane was broken in her medical examination, but the doctor did not give any opinion on sexual harassment.” The court gave bail to the filor, saying: “Consider the facts and circumstances of the case, as well as the nature of the crime, testimony, involvement of the accused and the arguments of the learned advocates of the parties, I believe that the requester offered a suitable case for bail.” The Supreme Court remained the order of the Allahabad High Court. On March 26, the Supreme Court remained the High Court of Allahabad stating that it would not be considered an attempt to rape a woman’s breasts and pull the pulse of her pajamas. The court said it shows “insensitivity” and “inhuman approach”. Justice Ram Manohar Narayan Mishra made these comments in his judgment on March 17.
