The Delhi High Court rejects pill that disputed the name 'Team India'

This petition was rejected after the lawyer Ripak was requested to submit better pills. The plea sought a direction against Prasar Bharati, a statutory body operating Doordarshan and All India Radio, to prevent the BCCI from being managed privately to refer to the team as the national team. It is said that BCCI is a private association registered under the Registration of Tamil Nadu, 1975, and not a statutory body in the meaning of Article 12 of the Constitution or the State. Furthermore, the requester also quoted that RTI received answers from the Union Ministry of Youth Affairs and Sport, which made it clear that BCCI was not recognized as a National Sports Federation (NSF), and that cricket was also not in the list of sport eligible for government grants. BCCI is also not declared a public authority under section 2 (h) of the RTI Act, 2005. Despite the above legal position, the pill states that Prasar Bharati still uses national symbols and terminology while referring to the BCCI cricket team. “Prasar Bharati’s platforms such as Doordarshan and All India Radio refer to the BCCI team as ‘Team India’ or ‘Indian National Team’, use the Indian national flag in BCCI’s cricket tournaments and indirectly give national status on a private association, giving a false impression in the public spirit. The requester argued that this practice the emblems and names (prevention of improper use), 1950 and the Flag Code of India, 2002, contrary to the use of national names, flags and symbols. “The abuse of the national name and flag by these public broadcasters not only deceives the citizens of India, but also destroys the holiness of national identity and symbols, which must be protected on the basis of constitutional prosperity and public trust,” the petition states. It also emphasizes that this portrayal has commercial implications. This false portrayal by the respondents helps a private entity to earn profits in the name of the country. When broadcasters like Doordarshan and All India Radio host the BCCI team as the Indian national team, it creates a false impression that the BCCI has official or government status. “This written petition is submitted to ensure that the national names, symbols and the Indian national flag are not abused, or associated with private commercial entities such as BCCI without proper statutory authorization or recognition,” the plea stating. The petition emphasizes “the need to protect public confidence and prevent citizens of India from being deceived that the BCCI officially represents the country as the ‘Indian National Cricket Team’.” -—IANS PAK
