Yusril guarantees that there will be no intervention at Delpedro's pretrial hearing
Jakarta – Coordinating Minister for Law, Human Rights, Immigration and Corrections, Yusril Ihza Mahendra, responded to Lokataru Director Delpedro Marhaen et al asking him to guarantee that investigators will be present at the first pretrial hearing. Yusril emphasized that there will be no intervention in the pre-trial process. “Pre-trial can be granted, it can be rejected, it can also be declared inadmissible or NO, it all depends on the facts and arguments revealed during the trial,” Yusril told journalists on Thursday (16/10/2025). If the respondent, in this case Polda Metro Jaya, represented by an investigator or someone authorized by him, is not present, the trial will continue. “I confirm that the Polda Metro Jaya will be present at the preliminary hearing at the second summons. At the first summons they may not attend. But at the second summons they will certainly attend. Because, if they are not present, the judge will continue the trial without the presence of the respondent,” said Yusril. Yusril then explained what could be tested in pre-trial. Among other things, whether the determination of a suspect, detention or arrest is valid or not. “Based on section 77 of the Criminal Procedure Code, the pre-trial object that is tested is whether the arrest is legal or not and whether the detention is legal. After a constitutional court decision, the pre-trial can also test whether the suspect’s determination is valid or not, including whether the search and confiscation is valid or not,” explained Yusril. As is known, Delpedro filed a preliminary hearing at the South Jakarta District Court regarding the determination of him as a suspect in connection with the demonstration that ended in chaos at the end of August. The lawsuit was also filed against Lokataru Foundation staff Muzaffar Salim, Gejayan Admin calling Syahdan Husein, and Riau University student and social media activist Khariq Anhar. The pre-trial proceedings are registered with case number 132/Pid.Pra/2025/PN JKT.SEL. The Accused or Respondent in this case is the Director of Cyber Investigation and the Director of General Criminal Investigation at Polda Metro Jaya. (fca/haf)
