The court of Dinesh Kumar, District and Sessions Judge with Special Judge of the POCSO Court, District Conduct Court, Garhwa, on Thursday found Amitabh Vishwakarma, a resident of Ataula of Meral police station, guilty of raping a minor girl and sentenced him to 20 years rigorous imprisonment, 000 imprisonment and a fine of 100. Let us tell you that an FIR has been filed on this incident on the written application of the victim on Meral police station case number 40/2024 dated February 18, 2024. According to the FIR, the victim was studying at her uncle’s house. On February 17, 2024, at 7:00 am, the victim was returning from her younger grandmother’s house after charging her mobile phone, during which Amitabh Vishwakarma of Ataula village suddenly held her hand from behind and covered her mouth. After this, the accused threatened that if she screamed, he would kill her. Fearing that, she became silent and the accused grabbed the victim, took her to the pigeon pea field and raped her. During the abuse and assault on the victim’s family members, the accused covered the victim’s mouth with a cloth, which prevented her from screaming. It was said that her aunt then started shouting the name of the victim. When the accused heard this, the victim left the victim. Then she ran to her aunt. The accused also came there from behind. When the victim’s aunt inquired about the incident, the accused and his relatives came there and abused and beat the victim’s relatives. Medical examination of the victim and statement recorded in court. Based on this information, the Meral police station registered an FIR, arrested the accused Amitabh Vishwakarma, completed the process and sent him to judicial custody. While the victim was medically examined and her statement was recorded in the court. The police filed the charge sheet against the accused Amitabh Vishwakarma in the court. While supplementary investigation continued against other accused in the FIR, Laxman Vishwakarma, Kamala Devi, Umesh Vishwakarma, Pratima Devi, Priyanka Devi. Later, after the investigation of this incident was completed and the truth was found, a charge sheet was also filed against those people. Thereafter, the court took cognizance of this case, framed charges and recorded the testimony of nine witnesses on different dates and on the basis of available documents and evidence, convicted Amitabh Vishwakarma on December 9, 2025 and acquitted Laxman Vishwakarma, Kamla Devi, Umesh Vishwakarma, Prayanti’s testimony. Today, after hearing on the point of punishment, Amitabh Vishwakarma was sentenced to one and a half years rigorous imprisonment under sections 504 and 506 of the Indian Penal Code and 20 years rigorous imprisonment under section (4)(2) of POCSO and a financial penalty of Rs 1 lakh.
