The Supreme Court in the Patna High Court, Patna, rejected the petition of the suspended judicial officer, Pratek Shail of the Rohtas district. The Patna High Court, with its important decision, rejected the plea of the suspended judicial officer, Pratek Shail of the Rohtas district, not only maintained the fir, but also ordered to hand over the investigation into the entire case to the Central Bureau of Investigation. The decision was made by a single bank of Justice Vivek Chaudhary while hearing the criminal written petition of Pratek Shail. The petitioner demanded the cancellation of the FIR (Alamganje police station number 747/2023) in connection with the death of his wife, in which he claims that Dowry Murder (IPC 304B). The court handed over the case to the Central Investigation Bureau, in light of the technical nature of this case, the basis of medical documents and the State Police which does not impose Articles 3 and 4 of the Indian Criminal Act and sections 3 and 4 of the Dowry Prohibition Act. The court instructed the investigating officer to hand over the case diary of the case, and seized items and documents to the relevant authority of the CBI by April 19, 2025. At the same time, the court instructed the requester to be surrendered to ACJM-6 in Patna within three days of the order. If this is not done, the non-available burden will be performed against them. The Court allowed the CBI to add section 304A of the Indian Criminal Act or alternately with section 304 Part II in the context of the Alamganic Police Station no. On behalf of the requester, Preferred Advocate Nivedita Nirvikar argued that the woman’s wife died of stomach TB.
