The decision came on a petition by Girja Shankar, who sought to stop the organization of a commercial fair in a college. This decision will apply to all educational institutions of the state. In a landmark ruling, the Allahabad High Court said that the immovable property of educational institutions of the state (including their playgrounds) cannot be used for commercial activities. This decision was taken by the division bench of Chief Justice Arun Bhansali and Justice Kshitij Shailendra while hearing a PIL. The Supreme Court directed the state government to issue a clear circular for this. In this, the district and police administration, educational institutions were asked to carry out the work according to the instructions of the court. What is the matter? In the PIL, petitioner Girja Shankar sought direction to the state authorities to stop the commercial fair from being organized at Brahmanand Degree College (a government aided college) as its purpose is to provide education. After the hearing, the division bench said that educational institutions are only meant to impart education, their land and buildings cannot be used for commercial activities. The decision must apply to all the educational institutions of the state. The court said that the immovable property of the educational institutions of the state, including their playgrounds, would also be destroyed. It cannot be used under any name for commercial activities. This decision will apply to all those educational institutions located in the state.
